The Fresh 20 Affiliate Agreement

Effective Date: February 27, 2025

This Affiliate Agreement ("Agreement") is entered into between The Fresh 20 ("Company," "We," "Us," "Our") and the individual or entity ("Affiliate," "You," "Your") who applies for and is approved to participate in The Fresh 20 Affiliate Program ("Program").

By signing up for the Program, you acknowledge that you have read, understood, and agree to be bound by the terms outlined in this Agreement.

1. Affiliate Eligibility

1.1. You must be at least 18 years old to participate in the Program.

1.2. You must provide accurate and complete registration information, including a valid email address and payment details.

1.3. We reserve the right to accept or reject any application at our sole discretion. Grounds for rejection include but are not limited to:

  • Promotion of illegal, offensive, or discriminatory content.

  • Websites that contain spam, misleading claims, copyright violations, or any other unethical practices.

  • Past violations of any advertising or affiliate policies.

1.4. The Fresh 20 reserves the right to terminate your participation at any time if we determine that you have violated any term of this Agreement.

2. Affiliate Account & Tracking

2.1. Upon approval, you will be provided with a unique affiliate tracking link to promote The Fresh 20 products.

2.2. It is your responsibility to ensure proper use of your affiliate link. We are not responsible for lost commissions due to incorrect link usage.

2.3. Commissions are tracked using cookies, which remain active for 60 days. If a customer makes a purchase after the cookie expires, the sale will not be credited to you.

2.4. Affiliates are not allowed to modify tracking links, use hidden redirects, or engage in cookie stuffing.

3. Commissions & Payments

3.1. Affiliates earn a 20% commission on successful purchases made through their unique tracking link.

3.2. Commissions are not earned on:

  • Refunds, chargebacks, or fraudulent transactions.

  • Affiliate purchases of The Fresh 20 products for personal use.

  • Transactions that fail to track due to user actions (e.g., cookie clearing, ad blockers).

3.3. Commissions are paid monthly, provided the minimum payout threshold of $50 is met. If your balance is below this amount, it will roll over to the next month.

3.4. Payments are made via PayPal. Affiliates are responsible for providing accurate payment details.

3.5. Unpaid commissions will expire if an affiliate remains inactive (i.e., no new referrals) for 12 consecutive months.

4. Prohibited Marketing Practices

Affiliates must not:

4.1. Bid on The Fresh 20 brand name, variations, or misspellings in paid search ads (Google Ads, Bing Ads, etc.).

4.2. Use misleading or false claims about The Fresh 20’s products.

4.3. Engage in spam tactics, including unsolicited emails, social media spam, or forced opt-ins.

4.4. Offer unauthorized discounts, rebates, or cash incentives.

4.5. Promote The Fresh 20 in any manner that violates advertising laws, FTC guidelines, or the terms of this Agreement.

Any violations may result in immediate termination and forfeiture of unpaid commissions.

5. Use of Branding & Content

5.1. You may use The Fresh 20’s approved marketing materials, including banners, images, and text descriptions.

5.2. Modifying or misrepresenting The Fresh 20 branding is strictly prohibited.

5.3. You may not copy, reproduce, or distribute The Fresh 20’s copyrighted content without explicit permission.

6. FTC Compliance & Disclosure Requirements

6.1. Affiliates must comply with the Federal Trade Commission (FTC) regulations and disclose their affiliate relationship.

6.2. Disclosure must be clear and conspicuous, such as:

  • “This post contains affiliate links. I may earn a commission if you purchase through my link, at no extra cost to you.”

6.3. Failure to disclose your affiliate relationship properly may result in account suspension or termination.

7. Termination & Account Violations

7.1. Either party may terminate this Agreement at any time with written notice.

7.2. The Fresh 20 reserves the right to suspend or terminate an affiliate’s account if:

  • The affiliate violates any terms of this Agreement.

  • The affiliate engages in fraudulent, misleading, or unethical marketing practices.

7.3. Upon termination, affiliates must immediately stop promoting The Fresh 20 and remove all affiliate links from their content.

8. Limitation of Liability

8.1. The Fresh 20 does not guarantee any level of income or success from participation in the Program.

8.2. We are not liable for:

  • Any lost commissions due to tracking errors, technical issues, or customer actions.

  • Any damages, including lost profits or business interruptions, resulting from participation in the Program.

8.3. The affiliate relationship does not create an employment, partnership, or joint venture with The Fresh 20.

9. Modification of Terms

9.1. The Fresh 20 reserves the right to update this Agreement at any time.

9.2. Affiliates will be notified of changes, and continued participation in the Program after an update constitutes acceptance of the new terms.

10. Governing Law

10.1. This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

10.2. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in California, United States.
